though i skipping alot of info!thats why when i see, a pregnant younger person downtown, that fit the criteria for c.a.s. targetting i offer them a card to my web site and tell them to skip all my stuff and go directly to the bottom, and direct them to ccw and mothers in exile!to assist them in the heads up!ect.

Since our family has experienced the onslaught of CAS's unethical tactics and lies we have also been approaching people all over. We constantly tell people of resources available to them and point them toward web sites that may aid them in knowing their TRUE rights when dealing with CAS and Family Law. Keep in mind this is an ACT, not a LAW. Which means you have to consent to their demands and can not be forced into doing anything. Most unwitting individuals think they must comply, which results in them signing consent forms, which then in turn does obligate them to comply. I hope telling people the truth does not intimidate you too much. We talk to people in the streets, knock on doors, hand out fliers and help people in the court house as well as in the CAS office. Watching the reactions of the staff is very similar to what I see here. Not very surprising. Sorry you are so threatened by people spreading the truth. Stunned

Legal aid is a joke and the only lawyers who accept legal aid, suck so bad they can't get someone to pay them except legal aid...... I think that is how the law society makes sure they all get a cut of the pie.
Anyone who uses a lawyer who accepts legal aid pretty much forfeits their children. Which I am pretty sure was the idea from the start.

I called Legal Aid 12 times with different wordings but all got the same response but only one "yes" but 11 said no. I worded exactly what the AG Site recommends "Child Protection Case" and I was told no. Then I worded it differently, loss of custody of child and if parent lost custody of a child and the child was removed in result of it from CAS, they said they will take it if the child was removed from Parent's custody. Then all the other 11 responses were no. I worded CAS, was flatly said no. I said Child Protection Case I was also said no. No where I never said the word under supervision, not at all. No where I said that. Just Child Protection case. and Child was in threat of being removed and all that. They say no to Child Protection Case BUT... they said yes if the child was removed from parent's custody I think they are talking about a Custody Case rather than Child Protection Case. I never said one word about Supervison order or such things. Just simiply said Child Protection Case and I was told no 11 times then I worded it differently and they said yes they will take my case IF the child was removed from parent's custody so that means it IS a CUSTODY CASE NOT CHILD PROTECTION CASE OR CAS. I asked for clariity and she (Legal Aid Rep) said they won't DO CHILD PROTECTION CASE BUT WILL DO CUSTODY CASE GIVEN IF THE CHILD WAS REMOVED FROM PARENT'S CUSTODY. So it is pretty tough to ask Legal Aid and was told no the first time around but after 11 times. WE DO NOT DO CHILD PROTECTION CASES. SIMPLY NO. I was not the only one that was told NO, there are several families like my situation, was also told NO. Yes I agree we need to take AG Site and tell him to shove it because it is a Lie. It is not the truth that we can get Legal Aid, it is all Lies. I even think AG Site is put on there to protect CAS interests, NOT YOUR INTERESTS. Hence Legal Aid won't do it. Why and Why not? Something gotta be done to tell AG that his recommendations on the site is not true because Legal Aid are turning down familie's case of "Child Protection Case"

I second what Reality said. Indeed, you CAN get Legal Aid when there is a Protection Application filed against you. I got Legal Aid after CAS did so.

Apprehension of a child by the CAS does not mean that the parent looses "legal custody" of the child. The only time the parent will loose legal custody of the child is if the court made an order to terminate parental rights. If CAS is involved but have not apprehended, you are not eligible for legal aid. If there has been an apprehension, you ARE eligible to apply for legal aid.

Just to clarify some of what Reality said...
My children were not apprehended by CAS directly, but I still qualified for Legal Aid. CAS filed a Portection Application where they asked for my ex to get sole custody. So, technically, they were not apprehended into CAS' care, but they were, in a sense apprehended from me. It should be noted that I never got approved for Legal Aid on the first attempt. Sometimes you have to let Legal Aid know that, if they don't give you what is fair, there will be consequences, including proving prejudice on their part.
(We had joint custody before CAS' PA, but CAS wanted me to lose my rights to see their files, etc., because they had been court ordered to be released to me and they showed CAS in a very negative light.)

I had the same thing happen to me. I was told that they could not issue me a certificate , I had to appeal their decision twice. The squeeky wheel gets the grease, just be sure to know your rights and make it well known that you will keep appealing until you get a certificate.
