Dean made reference in an earlier post to paralegals now having to be licensed with the Law Society. This is a major blow for independent paralegals but it is an even worse blow for children and families. What Dean is referring to is called the Access to Justice Act. It means that where people used to have the choice to have anyone more qualified than themselves provide representation in legal matters this is no longer the case. The only persons the court will allow to represent you are associated with the law society. So the lawyers have known sewn up the racket tight and ensured that all monies earned are subject to law society fees.
Prohibitions Non-licensee practising law or providing legal services
26.1 (1) Subject to subsection (5), no person, other than a licensee whose licence is not suspended, shall practise law in Ontario or provide legal services in Ontario. In order for a paralegal to operate now they must work for a lawyer as not many independents can afford the costly malpractice insurance the law society requires.
So if you need say an uncontested divorce that used to cost 300 you will now be paying about 650 as of may 1 as the law society will now be involved regulating those paralegals as well.
This is what the government posts as the meaning of this flawed act."An Act to promote access to justice by amending or repealing various Acts and by enacting the Legislation Act, 2006.
Access to Justice for who? Certainly not you and I or our children who will suffer because the government has cut off all means of affordable legal services to the citizens in need
