I was trying to find your address but could not. Any and all help is much appreciated.I'll keep trying though,Thanks I filed a motion in Family Court, asking for the Police records, as well as all the files from the two CAS agencies involved with my family. In my affidavit I explained clearly why I felt that these files needed to be released - namely, that CAS was hiding evidence and that the Police were being discriminatory and prejudiced against me. The Judge found the evidence in my affidavit compelling enough that he immediately ordered what I had asked for. Later, however, when I asked for other, similar information from a different Judge, he refused, stating that I hadn't made the other agencies "party" to the proceedings. Although, even lawyers have called it a grey area, it would seem like I have to name the other agencies as "Respondents" to the action in order to be successful. You may need to do teh same thing in order to get the Police records.

If you want police records and the CAS are not giving you what they have, the best place to get them is from the police. They have a freedom of information office that deals with that. I believe the cost is $5.00. Just write out a freedom of information form. One way or the other they have to answer you.

well, cathy they may tecnically have to respond, but they got their ways around that also! can send you copies of both my aplication under the freedom of information act and the polices responce, , claiming that they have no records or file on me what so ever for any domestic occurances,lmao actualy i can send you a audio recording to that effect, its entitled "SGT. COWARD", but whats even better is the tainted responce letter!

If the Freedom of Information Unit refuses your request or you feel they are not being truthful you may file a complaint with the Office of the Privacy Commissioner. You have a right to just about any information concerning yourself, this includes, documents videos and even officers notes. You can contact the Privacy Commissioner Ann Cavoukian at www.ipc.on.ca/or Information and Privacy Commissioner/Ontario 2 Bloor Street East Suite 1400 Toronto, Ontario M4W 1A8 In most cases the privacy commissioners office is favourable to you the person requesting and they act quickly.

One of the things that I mentioned in my affidavit - wherein I asked for the Police records in Family Court - was that, when you receive the records through FOI, a great deal of the information is blacked out, due to the privacy issue of others involved. A lawyer has told me that judges are usually quite eager to order records disclosed, since it gets the truth out more readily. I can only go by what happened in my case, but I got the records by simply filing a motion in Family Court. As I stated, the Police started co-operating after their records were released to me. Not surprisingly however, CAS filed the Protection Application against me in order to shut me up... temporarily.
