Families in spanking dispute may flee Canada Updated Sun. Jul. 29 2001 6:09 PM ET
CTV News has learned that dozens of people from Alymer, Ont. are considering a plan to claim refugee status in the United States. They fear Canadian authorities could seize their children because their fundamentalist church believes in spanking.
The families, all from Aylmer, Ont., fled Canada to parts of Ohio and Indiana three weeks ago after the Ontario Children's Aid Society seized seven Aylmer children from a family on July 6.
The seven kids in that case, aged six to 14, have all since been returned to their parents after a bitter court battle with child welfare officials.
However, the 30 mothers staying in the U.S. fear Canadian authorities might seize their kids too -- almost 100 in all -- if they return home. To prevent that from happening, they might claim refugee status under religious persecution before their six-month visitor's visa expires sometime in January.
They don't want any child protection agencies interfering with their own version of disciplining their children, said CTV's Samantha Shatzky in Dayton, Ohio.
The fathers have all remained behind in Aylmer to continue working.
The Ohio criminal code, as well as laws in Indiana, state parents are within their rights to use corporal punishment as a means to discipline their children.
Section 43 of the Criminal Code of Canada permits parents to spank their children, as long as it doesn't exceed reasonable force.
Shatzky said the families are paying particular attention to the court case which ensued after the seven kids were taken by the Children's Aid Society.
They want to watch how it progresses through the Canadian court system before they decide whether they are going to claim refugee status in the U.S., Shatzky said.
An Ontario judge ruled last week that the seven Aylmer kids should be returned to their parents provided they are closely monitored by Children and Family Services. The parents must also attend counselling sessions and allow their children to visit a doctor at the request of the agency and follow the doctor's medical advice.
The agreement also stipulates Family and Child Services must continue to learn about the religious tradition and cultural background of the family.
The deal is in effect until Sept. 6, when both sides return to court for a settlement conference.
The parents have promised not to use the rod to spank their children at least until then.
The kids were taken after a compliant by a neighbour.
The parents, who can not be named under a publication ban, had spanked their children with straps and wooden switches, which authorities believed to be excessive. However, the parents argued it was their God-given right to spank their children.
The family's pastor, Rev. Henry Hildebrandt of the Alymer Church of God, said the parents resorted to spanking the children with a strap because they believed it would be wrong to spare the rod. He believes the Bible states that the correct way to discipline children is with a rod.
Hildebrandt said the children also welcomed the punishments because it made them happy children.

www.fathers.ca/church_of_god1.htm I am trying to find out more updates on this family but I could not find any. It seems to look like these Government folks tries to silence this story....hush and hush. Really interesting. I remember on the News where I saw a Boy yelling and screaming, biting the Worker while she tries to push him into the vehicle. That had stuck into my mind ever since. That image....still does to this day. Many Families fled Canada because of this. I don't know if this Family still lives in Alymer though. If anybody knows of any updates on this Family, please post as I am interested and like to follow up that case and if CAS still interfered into their Lives to this day.

I found one snippet of what happens to the family, they can't get out of Ontario at all.... The agreement also bars the parents from taking the kids out of Ontario and requires them to accept counseling to learn "alternate methods of discipline." Hildebrandt said the church has no problem with those stipulations but is opposed to social workers making unannounced visits, which he says have "severely psychologically traumatized" the children.
