I spoke to legal aid here in Sarnia this morning and they told me because I'm applying for legal aid for my son (15 years old) they will deny him a lawyer unless the crown is going for jail time. Is this a normal legal procedure. And how would I find out before they deny me if they are asking for jail time? It seem's like a catch 22 here.

Have a look at the thread.. "Justice Judged to costly for most". There is an article in there that I just posted that addresses your question. This is a common problem with legal aid sarniasgun.proboards83.com/index.cgi?action=display&board=childrenaid&thread=1173407558&page=1"But being charged with a criminal offence is no guarantee of legal aid. Those not likely to go to jail if convicted – for instance, a first offender charged with breaking and entering – do not qualify for legal aid, even though a conviction can have serious consequences, such as harming career prospects. Legal aid is also not available to anyone charged in a case in which the Crown is seeking a conditional sentence. And someone convicted and sentenced to house arrest can't obtain legal aid for an appeal."

I personally would go to the crowns office and ask for the disclosure but the odds are being a young offender that there is no chance of incarceration. but stranger things have happened. to me this is a violation of her sons chartered rights, in this case if your not granted legal aid go to the court house get your discloser then go to the duty council office , duty council is a lawyer that works directly in the court house. every lawyer in Sarnia has to do so many hours as duty council they will help you with the discloser remember it can take weeks for them to release it so have Patience.

I remember the days when legal aid was available to anyone who needed and qualified for it financially. My divorce was paid for by legal aid. (a long time ago) My ex was billed $250 for the court proceedings. (it was a straight forward, uncontested divorce)
Wonder what it costs to get divorced these days.
